Privacy and consent before using Okayfood

TERMS OF USE – Okayfood 

Welcome to Okayfood. 

We are happy that you want to join the Okayfood community by using our services. Before you can access the Okayfood, you must give your explicit consent that we may register and use the data that you enter into the app. At the same time, you also acknowledge, that you understand, that the purpose of the Okayfood is to make it easy and safe for you to share information about your food preferences and food allergies, which according to the EU General Data Protection Regulation (GDPR) is regarded as personal data. You do this by agreeing to our Terms of Use. We encourage you to print or save these terms. You must pay special attention to the consent you give regarding treatment and sharing of personal data under sections 2 and 3. – Be aware that you are unable to use the Okayfood if you don’t accept our Terms of Use.

1) General information about the Okayfood

1.1. The Okayfood is an internet-based digital service that makes it easy to inform others,

if you have food preferences or food allergies. Eg. If you suffer from food allergy, are a diabetic, have celiac disease, are lactose intolerant, do not tolerate gluten, are a vegetarian / vegan, do not eat pork, etc.

1.2. For this purpose, we have developed a online version, an app and a administrator web-interface. These three services are integrated in such a way that private and professional users of Okayfood’s services easily, quickly and safely can share information about special food needs.

Personal safety & responsibility 

1.5. Your Okayfood-User Profile is personal and may only be used by you.

1.6. It is your own responsibility to ensure that you do not share your login information – eg. by exchanging usernames and passwords with others.

Stay informed about our terms of use and conditions

1.7. It is your own responsibility to stay informed about updates to these Terms of Use, which can always be found in the Okayfood. Your use of the Okayfood is subject to the current Terms of Use. Okayfood Aps can change the Terms of Use at any time without notice. Changes to the Terms of Use or technical changes that lead to significant restrictions in the Okayfood will be implemented with a prior notice of one month. Such notices will be given through the Okayfood. Changes of Terms of Use will never include sharing of your data without your explicit and specific consent.

2) General information about data created in the Okayfood

Mandatory information if you want to be able to use the Okayfood

2.1. Creation of your personal User Profile: 

If you do not want to submit the mandatory information, you can not use the Okayfood.

Information that is not mandatory, if you want to use the Okayfood.

2.2. Creation of Food Profiles – the PROFILE function: 

Your data will be registered by Okayfood Aps when you create your User Profile, your Food Profile and when you use the sharing function of the app.

Who will get access to the data that you have entered in the Okayfood system?

2.3. The people and companies / organizations that you choose to share your Food Profile with via the Okayfood. 

2.4. Okayfood Aps does not sell / transfer data from Okayfood to individuals,

companies or other third parties without yours specific and explicit

consent.

2.5. Okayfood Aps does not initiate the sharing of data between profiles or

between people and companies without your specific and explicit consent.

Purpose of Data

2.6. Okayfood Aps collects and stores the data that you enter into Okayfood-system when creating a profile and using the Okayfood.

2.7. Okayfood Aps uses data for the following purposes:

How do you delete data from the Okayfood system?

2.8. You can easily delete your Food Profile and the data you create within the Okayfood.

How to delete your Okayfood profile

  1. Click ‘settings.’  
  2. Click ‘delete account.’  
  3. You will then receive a delete code by email. It must be entered in the app.
  4. Confirm the deletion of your Okayfood profile .

Caution! 

Deletion of your personal Okayfood profile will automatically delete all data from the Okayfood Holding Aps systems. There is no possibility of recovery. A deleted Food Profile can not be restored by Okayfood Aps.

Who is the data controller?

2.9. Okayfood Aps is the data controller for the information that users of Okayfood enter into the App.

3) Rights for the users of the Okayfood

Sharing of my data

3.1. Okayfood users decide who they share their data with via the Okayfood.

3.2. Users of the Okayfood can change the information they enter into their Food Profiles at any time.

3.3. Users of the Okayfood can at any time withdraw their consent and with a few clicks remove all information from the Okayfood system. In case of a withdrawal of consent, the Food Profile is permanently deleted, so that Okayfood Holding Aps no longer has access to the user’s data or can restore that data.

3.4. Users of the Okayfood agree, that Okayfood Aps is not data-responsible for information shared via the ‘share by email’-function. Users of the Okayfood declare with this conscent, that the receiver of the email is then data-responsible. 

3.5. Users of the Okayfood who share their Food Profile with companies, organizations, institutions and associations using Okayfood Event agree that these companies, organizations, institutions and associations are entitled to print the users food profile for the purpose of planning their events.

3.6. Users of the Okayfood are ensured that companies / organizations using Okayfood Event have accepted to immediately destroy any printouts of food profiles as soon as an event has finished.

3.7. Users of the Okayfood are ensured that companies / organizations using Okayfood Event have accepted that they are not allowed to extract data from the Okayfood system by any other means than using the print function in the Okayfood Event .

3.8. Users of the Okayfood are ensured that companies / organizations using Okayfood Event have committed themselves to be able to document which persons have access to the Food Profiles related to an event. This applies for the access to the Okayfood users’ digital food profiles as well as for any printouts from the print function in the Okayfood Event.

3.9. Users of the Okayfood may appeal to the Data Inspectorate if they, for example, think that:

4) Security – How is my data secured at Okayfood Aps?

4.1. All sharing of information from food profiles is done internally in the Okayfood system, so non-authorized third parties can not access the information.

4.2. All data is encrypted.

4.3. All data in the Okayfood system is placed on secure servers within the EU.

4.4. Users of the Okayfood, who share their food profiles with companies, organizations and institutions using Okayfood Event, are additionally secured through the data processing agreements and security contract clauses which Okayfood Aps enters into with these companies, organizations, institutions and associations

4.5. Okayfood Aps automatically deletes inactive user profiles after a maximum of 3 years.

5) Responsibility

5.1. Users of the Okayfood write the content in the app’s profiles themselves. Therefore, the people behind Okayfood Aps can not be held responsible for errors, omissions, and inadequate information that may be in the food profiles that users create and share in the Okayfood.

5.2. The persons behind Okayfood Aps can not be held responsible for allergic reactions, anaphylactic shocks, accidents, losses, injuries, or disadvantages due to the content of the food profiles that users create and share in the Okayfood.

5.3. People who get information via the Okayfood can not be held liable for errors, omissions, and inadequate information that may be in the food profiles that users create and share in the Okayfood.

5.4. People who get information via the Okayfood can not be held responsible for allergic reactions, anaphylactic shocks, accidents, losses, injuries, or disadvantages caused by the contents of the food profiles that users create and share in the Okayfood.

5.5. Companies, organizations, institutions, associations, etc. that use Okayfood Event can not be held liable for errors, omissions, and inadequate information that may be in the food profiles that users create and share in the Okayfood.

5.6. Companies, organizations, institutions, associations, etc. that use Okayfood Event can not be held responsible for allergic reactions, anaphylactic shocks, accidents, losses, injuries, or disadvantages caused by errors, omissions or inadequate information in the food profiles that users create and share via the Okayfood.

5.7. Users of the Okayfood can not be held responsible for system failures, computer virus or operational malfunctions at companies, organizations, institutions, associations, etc. who use Okayfood Event.

5.8. The persons behind Okayfood Aps can not be held responsible for the extent to which companies, organizations, associations and institutions working with Okayfood Aps comply with applicable laws in relation to declaration information, ingredient lists, labeling schemes, etc.

5.9. The persons behind Okayfood Aps can not be held responsible for system failures, computer virus or operational malfunctions on the user’s or third party’s computer.

5.10. The persons behind Okayfood Aps can not be held responsible for content referred to or linked from websites belonging to Okayfood Aps.

5.11. The persons behind Okayfood Aps can not be held responsible for content of posts, links, images, extensions, etc., that users submit to social media. Eg. profiles on facebook, twitter and the like services.
